Fair Housing Act Provisions That Apply Directly to AI Systems

The Fair Housing Act (42 U.S.C. § 3604) prohibits discrimination in the sale, rental, and financing of housing based on race, color, national origin, religion, sex, familial status, and disability. How ML Models Can Inadvertently Violate the FHA

Training data bias compounds the proxy variable problem. If your model is trained on historical housing transaction data, it has learned from a market shaped by decades of discriminatory lending, steering, and appraisal bias. A model that predicts "will this property appreciate" based on historical comparable sales in a neighbourhood is learning — and perpetuating — patterns established by redlining. Required Testing Methodology: Adverse Impact Ratio and the Four-Fifths Rule

You cannot test for disparate impact without knowing group membership.

Calculate selection rates by protected class group

For each protected class under the FHA (race, color, national origin, religion, sex, familial status, disability), calculate the rate at which each group receives the favourable outcome (approval, shown listing, lower price, matched lead). Use the highest-selected group as the denominator.

Apply the four-fifths rule and statistical significance tests

Flag any group with a selection rate below 80% of the highest-selected group. For small sample sizes, supplement with chi-squared or Fisher's exact tests. Statistical significance matters: a 79% ratio with p=0.3 is less concerning than a 79% ratio with p=0.001.
