Florida AG announces investigation into OpenAI over shooting that allegedly involved ChatGPT

Read the full articleFlorida AG announces investigation into OpenAI over shooting that allegedly involved ChatGPT on TechCrunch

What Happened

ChatGPT had reportedly been used to plan the attack that killed two and injured five at Florida State University last April. The family of one victim has said that they plan to sue OpenAI over the incident.

Our Take

This is the lawsuit everyone saw coming. ChatGPT gets blamed for planning a shooting, AG opens an investigation, victim's family sues — the dominoes fall in order.

But here's what matters: OpenAI's now defending in court whether they had a duty of care. Legally they didn't. Juries don't give a shit about disclaimers though.

Expect a settlement in the millions, quiet NDA, and OpenAI adds one more line to their TOS that'll protect exactly nobody.

This shapes every AI company's legal strategy for 2026.

What To Do

Audit your product's terms of service for liability language — every AI company's TOS is about to shift hard after this settles.

Who

legal and trust-and-safety teams at consumer-facing AI companies

What changes

product liability framing for AI in harm scenarios is shifting from hypothetical to active litigation; terms-of-service and usage monitoring will face scrutiny

When

months

Watch for

whether the family's civil suit survives a Section 230 motion to dismiss — that ruling sets the real precedent

What Skeptics Say

State AG investigations of platforms over third-party harmful use have a near-zero conviction rate; this is political positioning ahead of an election cycle, not a serious legal threat to OpenAI's liability shield.
